Cop Rape lawyers trying to silence victim at sentencing.

In addition to asking the judge to forbid the accuser of speaking at the sentencing, lawyers for the men also requested that the charges against their clients be tossed out, because "for a person to be guilty of official misconduct, that person must both commit an unauthorized act and do so to obtain a benefit." Being present in the woman's apartment was the "unauthorized act," but because the men were acquitted of rape, their counsel argues that there was no benefit, therefore no crime.

There is a special place in hell for these thug piece of shit "lawyer" and his two rapists clients. I really, really hope both these rapists get the full sentence at the House of Many Doors. I hear they just looooove ex-cops there.

I OFTEN wonder how some defense lawyers can sleep at night. I mean, I know someone has to do it, but...doing it passionately well? What is WRONG with people?

The reason so many defense lawyers are reviled is not because of the basic parameters of their job--as you say,someone has to defend criminals. But this guy went beyond that--the arguments he used to smear the victim were just...truly repellant. She had internal bruising from the rape, bruising on her cervix--he argued she couldn't done it to herself "scrubbing vigorously" with a loofah. I mean, what the FUCK?

I blame every one of those fucking jurors. I hope they know how much they're despised. They keep giving interviews where they try to explain themselves--one came out earlier this week, one Melissa Hernandez, can't seem to shut up about it (http://gothamist.com/2011/06/27/rape_cop_juror_who_found_cops_innoc.php).

Now, on the eve of the two officers' sentencing for official misconduct, Hernandez has resurfaced with more of the same pointless and infuriating confessions.

Hernandez tells the Daily News she believes "in my heart" the two cops raped the unidentified woman, but like other jurors she decided that prosecutors failed to prove their guilt beyond a reasonable doubt. Some have dubbed this the "CSI effect," with one legal expert telling the Post, "CSI has made things difficult, there's no law saying that 'beyond a reasonable doubt' means we show you DNA. It means 'evidence that points to a moral certainty that is beyond dispute.' "

...Hernandez tells the News, "I hope [the judge] throws the gavel at them." Or the book, whatever. Something should be thrown at them, says the woman who let them walk.


I love how disgusted the Gothamist writer sounds. Shut the fuck up, Melissa Hernandez. You had a chance to do something. You didn't do it. Stop trying to make it okay--it's not. You failed, and you're a sorry excuse for a citizen, you and the other 11 jurors.

In other news, possibly related, there have been four sexual assaults in my neighborhood in the past 2 weeks. 2 actual rapes, 2 attempted. Thanks for making my city safer, Melissa!
