[More Michael Jackson BS--just skip it if you'd rather] I'm getting ready for bed now and Jay Leno is on, interviewing Dr. Phil. He asked him about the juries in California, asking why they never seem to convict. Dr. Phil went on about very high standards of evidence and said "I don't think there's a person on that jury who doesn't think MJ's a molestor" but the witnesses weren't up to snuff. Jay asked about common sense--"doesn't common sense play a part in this? Is a jury allowed to consider common sense?" I yelled at the TV YES! Dr. Phil said something about when you're considering whether to deprive someone of their civil liberties blah blah juryconsultantcakes. YES! You *are* allowed to use common sense! When I was on the jury and the judge charged us, he SPECIFICALLY told us we could use our common sense--I remember that, he was very explicit with us about the whole process, and took it and us very seriously. It's especially appropriate in a case like this, when it comes down to who's more believable? You don't have explicit, video evidence--*you* have to decide what the facts are.
